El excomandante de las FARC Jesús Santrich ha tomado este martes posesión de su escaño en la Cámara de Representantes tras un periplo judicial que en las últimas semanas sacudió la política colombiana. La Corte Suprema de Justicia, la máxima instancia de la jurisdicción ordinaria del país, ordenó hace 10 días la puesta en libertad del exguerrillero para que pueda afrontar un juicio por narcotráfico como aforado. El propio Santrich, que llevaba más de un año en la cárcel, tendrá que acudir en las próximas horas a ese tribunal para atender sus requerimientos. El partido nacido de la organización insurgente, la Fuerza Alternativa Revolucionaria del Común, tiene garantizados según los acuerdos de paz 10 escaños durante dos legislaturas repartidos entre Cámara y Senado.
El presidente Iván Duque, que en numerosas ocasiones ha calificado al excombatiente de “mafioso”, pidió el lunes al Ministerio Público que suspenda su cargo. “Espero que, dado que la Procuraduría está pidiendo que se capture, por parte de la Corte Suprema de Justicia, pues también que, con la evidencia que existe, la propia Procuraduría suspenda del ejercicio de ese cargo a esa persona”, afirmó el mandatario.
Al margen de las posiciones políticas, la imagen de Santrich participando en una sesión del Congreso puede repercutir en los ya delicados equilibrios del proceso de paz. “¿Cómo puede uno pretender que en un país tengamos un mafioso posesionándose como congresista?”, se preguntó Duque. “¿Cómo puede un país aceptar que se posesione alguien que tiene una acusación con esos testimonios tan claros de participación en narcotráfico? Eso, como mínimo, amerita una suspensión de la Procuraduría y, obviamente, lo que esperamos, también, es que la justicia opere y tenga una sanción proporcional, ejemplarizante y efectiva por esos actos de narcotráfico”, continuó.
El exguerrillero fue detenido en abril de 2018 a petición de un juzgado de Nueva York con el cargo de conspiración para exportar 10 toneladas de cocaína a Estados Unidos. Sin embargo, a mediados de mayo la Jurisdicción Especial para la Paz (JEP) dispuso su liberación y aplicó una garantía de no extradición, como contemplan los acuerdos alcanzados en 2016 en La Habana entre el Gobierno de Juan Manuel Santos y la antigua guerrilla. Esa decisión provocó la dimisión del fiscal general, Néstor Humberto Martínez, quien se negó a aceptarla. Horas después, renunció también la ministra de Justicia, Gloria María Borrero, alegando motivos personales.
Pero el fallo del tribunal encargado de juzgar los crímenes del conflicto armado no dispuso la salida inmediata de Santrich de la prisión de máxima seguridad de La Picota, en Bogotá. Cuando el exjefe guerrillero se disponía a pisar la calle, fue detenido de nuevo bajo cargos presentados por la justicia ordinaria. Finalmente, fue la Corte Suprema el órgano que cerró, al menos por el momento, el caso permitiendo a Santrich afrontar esos cargos como congresista. Este lunes mismo, la Cámara de Representantes debatió una moción de censura contra el ministro de Defensa, Guillermo Botero, motivada en buena medida por la gestión informativa de un caso de asesinato de un exguerrillero de las FARC desmovilizado. El ministro recabó el respaldo de la mayoría de las bancadas.
